Terms and Conditions

1. Application of Terms

These Terms and Conditions govern the use of the website operated by Clear Focus ADHD Clinic (“we”, “us”, “our”) and the booking, attendance, and provision of medical services, including ADHD assessments, diagnostic consultations, and follow-up appointments. By accessing or using the website, booking an appointment online, or attending an appointment, you agree to be bound by these Terms and Conditions.

2. Definitions

In this Privacy Policy, “Personal Information” and “Sensitive Information” have the meanings given to them under the Privacy Act 1988 (Cth). “Website” means this website and any online platform, booking system, or telehealth portal operated by us.

3. Use of the Website

Access to and use of the website is subject to these Terms and Conditions. You must use the website lawfully and in accordance with applicable laws and regulations. You agree not to use the website to: transmit unlawful, harmful, or offensive material; interfere with or disrupt website functionality; or attempt to access restricted areas of the website or any accounts without proper authorization.

While we strive to ensure that information on the website is accurate and up to date, we do not guarantee the completeness, accuracy, or reliability of content. The website is provided for general informational purposes only and does not constitute medical advice. Any reliance on information obtained from the website is at your own risk.

We may use cookies, analytics, or similar technologies to collect information about your use of the website, improve website functionality, and enhance user experience. By using the website, you consent to such collection in accordance with our Privacy Policy.

The website may contain links to third-party websites. We are not responsible for the content or privacy practices of third-party websites, and this Terms and Conditions document does not apply to such websites.

4. Appointments and Bookings via Website

Appointments made through the website are subject to the same policies as other bookings. All appointments must be confirmed at least twenty-four (24) hours prior to the scheduled appointment time. Failure to confirm may result in automatic cancellation and release of the appointment slot to another patient.

Information submitted through the website, including online forms and booking requests, must be accurate and complete. You are responsible for any errors, omissions, or false information submitted.

5. Cancellation and Non-Attendance Policy

If you are unable to attend an appointment booked online or in-person, you must provide a minimum of twenty-four (24) hours’ notice of cancellation or rescheduling. Failure to provide such notice, failure to confirm your appointment, or failure to attend will be recorded as a Did Not Attend (“DNA”).

A DNA fee of AUD $150 applies for any appointment where insufficient notice is provided, the appointment is not confirmed as required, or you fail to attend. This fee reflects the reserved time and is payable regardless of the reason for non-attendance. Payment of the DNA fee may be required before booking future appointments.

6. Fees and Payment

Fees for consultations are payable as advised at the time of booking, including bookings made via the website, and prior to or at the time of the appointment. Payment is accepted through the methods specified on the website or as otherwise agreed.

Fees are subject to change, and the fee applicable will be that disclosed at the time of booking. Medicare rebates, private health insurance rebates, or other third-party reimbursements are subject to eligibility and compliance with applicable requirements, and we are not responsible for any rebates that are declined or reduced.

7. ADHD Assessments and Reports

ADHD assessments may require multiple appointments, completion of questionnaires, collateral information, and supporting documentation. You are responsible for providing accurate and complete information via the website, email, or in-person, and for returning all required forms within the specified timeframes.

Reports, letters, and documentation are prepared based on the information provided and clinical findings. We do not guarantee any particular outcome, diagnosis, approval, or acceptance of reports by third parties.

8. Telehealth Appointments

Telehealth consultations accessed through the website are subject to the same terms as in-person consultations. You are responsible for ensuring appropriate technology, internet access, and a private environment for telehealth appointments.

We are not responsible for interruptions, technical failures, or limitations beyond our control. Telehealth appointments remain subject to all cancellation, confirmation, and DNA policies.

9. Patient Responsibilities

You are responsible for providing accurate, honest, and complete information through the website or otherwise, including medical history, medications, and relevant personal details. You must ensure punctual attendance. Late arrival may result in a shortened consultation or cancellation at our discretion and may incur full consultation fees.

10. Limitation of Liability

To the extent permitted by law, we exclude all liability for any loss, damage, or expense arising from use of the website or reliance on information provided through the website or during consultations, except where liability cannot be excluded under applicable legislation.

11. Privacy

Personal and health information collected through the website is handled in accordance with our Privacy Policy and applicable privacy legislation.

12. Amendments

We may amend these Terms and Conditions at any time. Any amendments will take effect upon publication on the website. Continued use of the website or attendance at an appointment constitutes acceptance of updated terms.

13. Governing Law

These Terms and Conditions are governed by the laws of the State or Territory in which the practice operates and the laws of Australia. Any disputes are subject to the exclusive jurisdiction of the relevant courts.
